This document summarises the cover provided by the Children's IndoorPlay policy and should be read carefully before you complete the Proposal Form. Public Liability

This covers your legal liability for accidental bodily injury to the public or damage to their property as a result of defects in the premises or plant or negligence by you or your employees.

Limit of indemnity:
  • £2,000,000 (higher limit available on request)
Automatically included:
  • Legal costs incurred in the defence of criminal proceedings in respect of a breach of the Health and Safety at Work Act 1974 - limit of £10,000 in any one period of insurance
  • Legal defence costs and expenses incurred subject to written consent of Sterling Insurance Company Limited. This is in addition to the limit of indemnity
  • Other legal liabilities such as interference with or loss of enjoyment of property as a result of obstruction, trespass or nuisance; non-owned motor contingent liability; cross liabilities; leased, hired or rented premises; those incurred under the Defective Premises Act 1972
Territorial limits:
  • Anywhere in Great Britain, Northern Ireland, the Isle of Man or the Channel Islands
Main exclusions:
  • Professional liability
  • Provision of advice or any plan, design, formula or specification given separately free of charge
  • Fines, penalties or liquidated, punitive or exemplary damages
  • Actions brought outside Great Britain, Northern Ireland, the Isle of Man or the Channel Islands
  • The first of £250 of property damage claims occurring away from your premises
  • Liability arising, directly or indirectly, out of exposure to inhalation of, or fears of the consequences of exposure to, inhalation of asbestos
  • Cost of cleaning up or removal of or damage to property arising out of asbestos
  • Terrorism, war and kindred risks
  • Activities not advised to and agreed in writing by Morton Michel

Employers' Liability

If you are an employer, you are required by law to have Employers' Liability Insurance. This covers you in case an employee suffers an accident at work for which you are held legally responsible. Employees are defined as paid or unpaid supervisors, students, work experience students, trainees and volunteers. This complies with current UK legislation.

Limit of Indemnity
  • £10,000,000 any one cause (£5,000,000 if arising out of terrorism)
Automatically Included
  • Legal costs incurred in the defence of criminal proceedings in respect of a breach of Health and Safety at Work Act 1974 : limit of £10,000 in any one period of insurance
  • Legal defence costs and expenses incurred with the written consent of Sterling Insurance Company Limited

Product Liability

This covers your legal liability for accidental bodily injury or damage to property caused by products manufactured, sold, supplied, repaired, serviced, tested, processed, assembled, installed or altered.

Limit of Indemnity
  • £2,000,000 (higher limit available on request)
Automatically Included
  • Legal costs incurred in the defence of criminal proceedings in respect of a breach of the Consumer Protection Act 1987 or the Food Safety Act 1990 - limit of £25,000 in any one period of insurance
  • Legal defence costs and expenses incurred with the written consent of Sterling Insurance Company Limited. This is in addition to the limit of indemnity
Main Exclusions:
  • Professional liability
  • Provision of advice or any plan, design, formula or specification given separately for a fee
  • Claims arising from any product, manufactured, constructed or prepared in accordance with their plan, design, formula or specification failing to perform the function for which they are intended by you
  • Fines, penalties or liquidated, punitive or exemplary damages
  • Loss of, or damage to products as the cost of making good or recalling such products
  • Actions brought outside Great Britain, Northern Ireland, the Isle of Man or the Channel Islands
  • Liability arising from or caused by any toys or play equipment, made, repaired, altered or modified by you

Property Damage

Contents, buildings, tenants improvements, glass, stock, belonging to you or by which you are responsible are covered against fire, lightning, explosion, aircraft, theft involving forcible or violent entry or exit, robbery, riot or civil commotion, malicious damage, earthquake, impact, storm or flood, leakage of water or oil, sprinkler leakage, falling trees or branches.

Buildings are defined as "the buildings, outbuildings and their foundations; landlord's fixtures and fittings; extensions, annexes, gangways and conveniences; walls, fences and gates; piping, ducting, cable wires and associated control gear and accessories on the premises or in the buildings and extending to the perimeter there of or the public mains; yards, car parks, pavements, pathways and roadways".

  • Architects and surveyors fees
  • Public authority costs
  • Temporary removal
  • Debris removal (including stock)
  • Capital additions up to 10%
  • Accidental damage to sanitary ware, underground pipes and cables if you are responsible
  • Replacement of locks and keys following theft of keys up to £1000
  • Damage to the premises (including glass) caused by theft involving forcible or violent entry
  • Computer systems records up to £5000
  • Reinstatement of landscaped gardens and grounds following damage by fire brigade up to £5000
  • Breakage of or damage to fixed internal and external plain plate or sheet or wired glass in the building, up to £2000 in any one period of insurance
Main exclusions:
  • The first £250 of each claim
  • Damage by subsidence, heave or landslip
  • Damage by water or oil, to property in basements unless adequately stillaged
  • Glass which has been broken or cracked before insurance commenced
  • Armoured, bent or special glass, or lettering or designs superimposed on glass
  • Terrorism, war and kindred risks
  • Accidental damage

Business Interruption - Loss of Revenue

This provides protection against financial loss during the chosen indemnity period for the business to return to normal following loss or damage of any of the insured perils.

The sum insured is based on an estimated annual gross revenue, earned in the next 12 months (or longer period that you choose), which should take into account anticipated growth and inflationary factors. Any inadequacy in the Gross Revenue at the time of loss will result in the amount paid being proportionately reduced.

Automatically included:
  • Prevention of access or loss of attraction due to change of nearby premises
  • Loss caused by damage at land based premises of public utilities or telecommunications undertakings up to £25,000
  • Professional accountants charges incurred in making a claim
Main exclusions:
  • Terrorism, wars and kindred risks

Refrigerated Stock

This covers for deterioration of stock caused by breakdown of refrigeration units.

Main exclusions:
  • The first £100 of each claim
  • Deliberate act of the supply authority
  • Loss in any unit over 10 years old
  • Loss involving a unit not subject to a maintenance contract.

Money

This provides loss of money whilst:

  • In transit or in bank night safe (up to £2000)
  • On premises during business hours (up to £2000)
  • On premises outside business hours in locked safe (up to £1000)
  • On premises outside business hours not in locked safe (up to £100)
  • In home of insured or authorised employee (up to £500)

Non-negotiable money is covered up to £100,000. Non-negotiable money is defined as "crossed cheques, postal orders, money orders, bankers drafts, national giro drafts and payment orders, dividend warrants, national saving certificates, unused postal franking machine units, stamped or impressed national insurance cards, holiday with pay stamps and premium bonds, VAT purchase invoices, credit card cheques and debit card sales vouchers, consumer redemption vouchers.

Automatically included:
  • Repair or replacement of safes, postal franking machines, security cases, bags or waistcoats following theft up to £2500 in any one period of insurance
Main exclusions:
  • The first £100 of each claim
  • Shortages due to error or omission
  • Loss from any unattended vehicle
  • Fraud or dishonesty of any director, partner or employee unless the loss is discovered within 7 working days of the date of occurrence

Personal Assault

Principals and employees (ages 16-65 inclusive) are automatically covered under the Money section if they sustain bodily injury or death following an assault whilst handling money on your premises.

Benefits payable are:
  • Death, loss of limbs or eyes - up to £10,000
  • Permanent total disablement - up to £10,000
  • Temporary total disablement (not exceeding 104 weeks) - up to £100 per week
  • Clothing and personal effects - up to £250 per person
Main exclusions:
  • Death or disablement caused by the influence of drugs or liquor
  • Any pre-existing physical or mental disability or infirmity, medical condition or chronic or recurring ailment, pregnancy or childbirth
  • Any communicable disease

Additional Policy Information

  • All employees and volunteers must be checked using the Criminal Records Bureau procedures
  • All equipment, mechanical rides, vending and amusement machines, must be installed, maintained and repaired by a specialist company
  • Staff must have relevant experience or qualification in care or supervision of children. Further details are available in the Insurance Information Sheet.
  • Minimum security as set out in the Guide to Security is required. All security devices are to be put in full and effective operation whenever the premises are closed or left unattended. Additionally, there may be specific warranties concerning security and fire alarms and fire extinguishing equipment applied. All changes of or to security devices must be notified to Morton Michel
  • Sums insured to be adequate, up to date and checked regularly
  • Exclusion of Velcro wall and "bar fly" or similar equipment
  • Manufacturers or suppliers guidelines/instructions for the use of any equipment including inflatable play equipment (such as 'bouncy castles' and the like) and trampolines must be complied with at all times
  • No adult to be allowed to play on the equipment
  • Use of a trampoline to be restricted to one child at any time
